  3. The employer defense to a harassment claim turns on showing reasonable care to prevent and correct harassment: Faragher v. City of Boca Raton, 524 U.S. 775 (1998) and Burlington Industries v. Ellerth, 524 U.S. 742 (1998). Training records are the ordinary proof. For co-worker harassment, liability turns on employer negligence: Vance v. Ball State University, 570 U.S. 421 (2013). Mandated jurisdictions require records of their own, for example Chicago 5 years, NYC and Maine 3 years.
  4. Title VII does not impose individual liability on supervisors (Miller v. Maxwell’s International, 991 F.2d 583, 9th Cir. 1993), but state and local laws can: California Government Code §12940(j)(3) makes an employee “personally liable” for harassment they commit, and the NYC Human Rights Law reaches individuals. When the harasser is a supervisor, the employer is vicariously liable (Vance).
